Etsy Risk Checker Pro provides a preliminary screening tool that analyzes product listing text for potential trademark, copyright, and policy compliance risks on the Etsy marketplace. The Service uses artificial intelligence and a database of known trademark enforcement patterns to generate risk assessments.

3. Disclaimer of Legal Advice

You should consult a qualified attorney for legal matters related to intellectual property, trademarks, copyrights, or any other legal concerns. No attorney-client relationship is created by your use of this Service.

4. Accuracy and Limitations

• The Service does not guarantee 100% accuracy in detecting all potential risks or violations.
• The trademark and compliance database may not include all active trademarks, pending applications, or recent enforcement actions.
• AI-generated analysis may produce false positives (flagging safe content as risky) or false negatives (missing actual risks).
• The Service does not cover all possible legal risks, including but not limited to: design patents, trade dress, common law trademarks, unregistered marks, or jurisdiction-specific regulations.
• Results reflect the information available at the time of the scan and may not account for subsequent legal developments.

5. User Responsibility

You acknowledge that:

• All final decisions regarding product listings, including whether to list, modify, or remove a product, are solely your responsibility.
• A "low risk" or "safe" result from the Service does not guarantee that your listing is free from legal risk.
• You are solely responsible for ensuring your listings comply with all applicable laws, regulations, and marketplace policies.
• You will not use the Service to intentionally circumvent intellectual property protections or to evade legitimate enforcement actions.

6. Free and Paid Plans

The Service offers both free and paid subscription plans. Free plans have daily usage limits. Paid plans provide additional features and higher or unlimited usage. All fees are listed in USD and are non-refundable except as required by applicable law or as explicitly stated in our refund policy.

We reserve the right to modify pricing, features, and plan structures at any time with reasonable notice to existing subscribers.

7. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Providing accurate and complete information during registration.

• Etsy Risk Checker Pro, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.
• We are not liable for any losses resulting from reliance on the Service's analysis, including but not limited to: listing removals, account suspensions, legal actions, lost revenue, or reputational harm.

10. Indemnification

You agree to indemnify and hold harmless Etsy Risk Checker Pro, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or the rights of any third party.
• Any listing decisions you make based on or in connection with the Service's results.

11. Data and Privacy

We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to the collection and use of information as outlined therein. We implement reasonable security measures to protect your data but cannot guarantee absolute security.
